The Law on the Protection of Whistleblowers of the Republic of Lithuania (hereinafter referred to as the Law) establishes a protection mechanism for persons who have provided information about violations in an institution with which they have or had a service or employment relationship or a contractual relationship. The Law also establishes the rights and obligations of persons who report violations in institutions, the grounds and forms of their legal protection, as well as measures for the protection, encouragement, and assistance of these persons, in order to create appropriate opportunities to report violations of the law that threaten or violate the public interest, and to ensure the prevention and disclosure of such violations.
The procedure for providing information about possible violations being prepared, committed, or committed at the Palanga Tourism Information Center, the procedure for receiving information about violations, its assessment and decision-making procedures, and the measures applied to protect whistleblowers are set out in the Procedure for Providing Information about Violations at the Palanga Tourism Information Center, approved by Order No. V-3 of the Director of the Palanga Tourism Information Center on January 12, 2024, V-3 of the Director of the Palanga Tourism Information Centre on 12 January 2024, drawn up in accordance with the Law on the Protection of Whistleblowers of the Republic of Lithuania and the Law on the Protection of Whistleblowers of the Republic of Lithuania and Resolution No. 1133 of the Government of the Republic of Lithuania of 14 November 2018 on the implementation of the Law on the Protection of Whistleblowers of the Republic of Lithuania.
In accordance with the Law, information on violations is provided in relation to:
threats to public safety or health, human life or health;
danger to the environment;
obstruction or unlawful interference with investigations conducted by law enforcement authorities or courts in the administration of justice;
illegal financing of activities;
unlawful or non-transparent use of public funds or property;
unlawfully acquired property;
concealment of the consequences of a violation, obstruction of the determination of the extent of the consequences;
violations specified in the list approved by the Minister of Justice of the Republic of Lithuania, prepared in accordance with the scope of application of European Union legislation specified in Directive (EU) 2019/1937;
damage to the financial interests of the European Union, as referred to in Article 325 of the Treaty on the Functioning of the European Union and further specified in the relevant European Union measures;
infringements related to the internal market, as referred to in Article 26(2) of the Treaty on the Functioning of the European Union, including infringements of European Union competition and state aid rules, as well as infringements related to the internal market due to actions that violate income tax rules; or agreements aimed at obtaining a tax advantage that undermines the object or purpose of the applicable income tax law;
other infringements.
A person may submit information about an infringement to:
the Palanga Tourism Information Center (TIC) via the internal channel for reporting violations (by email to info@visit-palanga.lt); we recommend submitting the report by filling out this violation report form or by submitting a free-form report (information is provided in accordance with the Whistleblower Protection Act).
in person at the Competent Authority at Vytauto g. 94, Palanga.
The person who submitted the information about the violation will be treated with CONFIDENTIALITY.
The requirement to ensure confidentiality does not apply when:
the person submitting or having submitted the information about the violation requests it in writing;
the person submits information that is known to be false.
The person shall not be liable for any contractual or tortious liability, or liability for defamation or slander, for providing information about the violation if, in providing the information about the violation in accordance with the procedure established by law, he reasonably believed that they were providing accurate information.
A person shall be liable for damage caused by the provision of information about a violation only if it is proven that the person could not reasonably believe that the information they provided was accurate.
The provision of knowingly false information, as well as information constituting a state or service secret, does not grant a person guarantees under the Law. A person who has provided knowingly false information or disclosed a state or service secret or professional secret shall be liable in accordance with the procedure established by law.
